A Special Meeting of the Board of Trustees of Boundary County School District No. 101 was convened at the above stated time and date, pursuant to authority provided by Section 33-510 and 67-2345, Idaho Code, and pursuant to affirmation by the clerk that written notice was conspicuously posted at the District Administration Office, Valley View Elementary School, Bonners Ferry High School, Bonners Ferry Herald Office, and the Boundary County Courthouse on 16th day of February, 2005. Trustees had actual notice of the time and date of meeting via telephone and reminder notification.
Board Members Present: Chairman Melanie Staples, Vice-Chairman Tim Bertling and, Trustees Craig Wheatley, Maria LaBarbera and Gil Hagen.
Superintendent Don Bartling, Clerk Diane Cartwright and Assistant Clerk Laurie Smith-Tremble were also in attendance.
Others Present: Walt Pippo, Robert DelGrosso, Chuck Quillin, Tom Oxford, Nissa Joseph, and Francine Santoro. Exhibit 1

Discussion was held to share and clarify board members questions and opinions regarding the Maintenance & Operation (M&O) Levy Election prior to the decision process.

II. Decision on the Amount to be Requested at the March 27, 2007 Supplemental Maintenance & Operation (M&O) Levy Election.
Francine Santoro, Evergreen Elementary Teacher, shared her experience of visiting the Farmin Stidwell Elementary School in Sandpoint and the positive presentation of their current M&O Election. They clearly defined the costs in an optimistic manner. Ms. Santoro also wanted to stress the increase of 1% to the sales tax did not add funds to the school districts.
Don Bartling wanted to remind everyone that this district is not alone and there are 60 school districts in Idaho currently running M&O Levies.
Chuck Quillin had questions regarding the amounts requested for textbooks in the past and currently. Melanie Staples suggested he speak with Brenda Walter, Curriculum Director, for clarification.
Robert DelGrosso read a letter he had written addressing his views and desires for the M&O Election. He initially questioned the election being held prior to the Idaho State Legislature having approved the State Department of Education’s Budget for the 2007-2008 school year. Mr. DelGrosso also requested the amount requested not to exceed $800,000.
Gil Hagen stated closing Naples Elementary would not be in the best interest of education. Tim Bertling stated his desire not to close Naples Elementary and to find the money somewhere else to be included in the election amount. Melanie Staples asked Don Bartling and Diane Cartwright how much more funds are necessary to maintain Naples Elementary now than two years ago? Diane stated the building and ground maintenance costs have escalated greatly as well as the utilities and supplies.
Diane Cartwright wanted to explain the 1% increase to the Idaho State Sales Tax: The 1% tax increase does not add funds to the school district; it replaces the local property tax payers’ burden by removing the Basic Maintenance & Operation from the tax rolls.
The Board continued to agonize over the items previously included on the 2005 M&O Election which included Naples Elementary, but with their decision to keep Naples open they had to reevaluate the list of items to be included. Craig Wheatley stated the previous Levy list was the prior board’s list and the current board can have a different list of what is to be included on the M&O Levy.
7:30 p.m. Craig Wheatley moved to take a short break. Tim Bertling seconded. Motion carried.
7:35 p.m. Chairman Melanie Staples called the meeting back to order.
The Board discussed the actual running of the election. Dr. Bartling stated an M&O election can be run every 30 days. Maria LaBarbera moved to run the M&O Levy Election twice only. Motion died for lack of a second.
Walt Piippo made an impassioned plea asking the Board and citizens to truly understand how the schools have been operating on a “bare bones” budget for many years.
The Board continued to struggle with the previous items, current requests and known increases to arrive at an acceptable levy amount for tax payers while providing the children of Boundary County with an adequate education. Tim Bertling moved to set the M&O Levy Election amount at $885,845. Maria LaBarbera seconded. A Roll Call Vote was taken: Gil Hagen, yes; Craig Wheatley, yes; Maria LaBarbera, yes; Tim Bertling, yes; Melanie Staples, yes. Motion carried.

M&O (Supplemental) Levy Election Resolution
WHEREAS, in the opinion of the Board of Trustees of Boundary County School District #101, Boundary County, State of Idaho, there is a need for a M&O (Supplemental) Levy, as provided in Idaho Code 33-802(4), in the amount of $885,845 per year for 2 years, for the purpose of paying all lawful expenses of maintaining and operating the schools of the District for the fiscal year beginning July 1, 2007 and ending June 30, 2009 (2years).
NOW, THEREFORE, be it resolved by the Board of Trustees of Boundary County School District #101, Boundary County, Idaho as follows:
Section 1: That a supplemental levy election be and the same is hereby called to be held in Boundary County School District #101, Boundary County, State of Idaho, on Tuesday, March 27, 2007, for the purpose of submitting to the qualified electors of the District, the question set out in the form of ballot appearing in Section 8 thereof.
Section 2: That on said date the polls shall be open between the hours of 11:00 a.m. and 8:00 p.m.
Section 3: That said election shall be held as specified in the form of notice set out in Section 10 thereof.
Section 4: That said election shall be conducted as other school elections and the persons to conduct said election, being two judges and one clerk at each polling site, shall be duly appointed by the Board of Trustees of Boundary County School District #101.
Section 5: That the polling places of said election shall be as follows:
Bonners Ferry High School Boundary County Middle School
Valley View Elementary School Naples Elementary School
Mt. Hall Elementary School Evergreen Elementary School
Section 6: That no person shall vote at such Supplemental Levy Election who is not at the time of the election:
1. Eighteen (18) years of age or older.
2. Citizen of the United States.
3. Resident of Boundary County School District #101, Boundary County, State of Idaho at least thirty (30) days preceding the election.
Section 7: That no person shall be permitted to vote at said election until such person shall have executed, in writing and immediately before voting, an elector=s oath attesting that he or she possesses the qualifications of an elector prescribed by 33-405,Idaho Code, as amended. The elector’s oaths shall be prepared by the Clerk of the Board of Trustees and shall be in substantially the following form:

March 27th, 2007 - M&O (SUPPLEMENTAL) Levy
I hereby swear (or affirm) that I possess all the qualifications of a school elector as prescribed in Idaho Code 33-405 and that this is the first time I have voted in this election. The requirements of Idaho Code are known to me to include:
a) The voter to be at least 18 years of age at the time of voting;
b) The voter to be a United States Citizen who has resided in this state and in the school district at least thirty (30) days preceding the election in which the vote is being cast;
c) The voter, if voting in a school trustee election, must be a resident of the same trustee zone for which he/she is offering to vote;
d) The voter understands that registration requirements set forth in Chapter 4, Title 34, Idaho Code, shall be applicable to school elections, and in addition to the foregoing qualifications, a school elector shall have executed, in writing and immediately before voting, a form of elector’s oath attesting that he/she possesses the qualifications of a school elector prescribed by in this section and indicating the mailing address, residence address or any other necessary information definitely locating the residence of the school elector. The elector may be required to furnish to the election official proof of residence, which proof shall be established by either an Idaho motor vehicle driver’s license or any other document definitely establishing the elector’s residence within the school district or trustee zone.
e) The voter understands this elector’s oath will be included in the records and returns of the board of elections; and
f) The voter, by signing this elector’s oath, attests that he/she possesses the qualifications of a school elector.

Section 9: That immediately following the close of the polls, the Board of Election shall compute the result of the election, making the count in public view, and shall immediately within not more than three days thereafter make return of the election to the Chairman of this Board of Trustees, upon forms to be supplied by the board, and must transmit therewith to this board all elector’s oaths and all ballots cast at said election, whether such ballots were counted by said board or not, or rejected thereby. The returns of election, elector’s oaths and the ballots shall be transmitted under seal. This Board of Trustees shall thereupon canvas such returns at a meeting to be held for that purpose at the regular meeting place of the board at a time to be later announced, and if a majority of the electors voting in such election are in favor thereof, the same may be thereupon certified.

The voting places are Bonners Ferry High School, Boundary County Middle School, Valley View Elementary School, Mt. Hall Elementary School, Naples Elementary School and Evergreen Elementary School. All qualified registered voters residing within the district are eligible to vote at said election. Qualified voters may vote at any district polling site for a Maintenance and Operation Levy.
Qualifications of an Elector
Every male or female citizen of the United States, eighteen (18) years old, who is a resident in the State of Idaho, County of Boundary, and the Boundary County School District No. 101, and has been for at least thirty (30) days prior to day of said election and who is a registered voter is a qualified elector.
Any person who is eligible to vote may register on election day by appearing in person at a polling place established for this election, by completing a registration card, making an oath on the form prescribed by law, and providing proof of residence, in the manner provided by Section 34-408A,Idaho Code, as amended.
Absentee Voting Idaho Code 33-406
A qualified school elector may vote in said election by absentee voting. The application for an absent elector’s ballot shall be filed with the clerk not later than 5:00 p.m. on the day before the election. Any such elector may make written application to the clerk for a ballot of the kind to be voted on at such levy election, which application shall contain the name of the elector, his/her present address and the address to which the ballot should be mailed, if applicable. Ballots may be released, after receipt of application for absentee voting no earlier than 28 days prior to the election. Applications are available at the District Administration Office located at 6577 Main Street, Suite 101, Bonners Ferry and on the school district website: www.bcsd101.com. The absentee ballot must be received by the clerk, not later than 8:00 p.m. on the day of the election, before such ballot may be counted.

The Clerk of the Board of Trustees shall cause notice of election to be posted for at least 21 days prior to the dates of said election in at least three public places within the district, one of which places shall be at or near the main door of the Administration Office in said District in Boundary County, Idaho. The Clerk shall also cause the notice of election to be published at least once a week for two consecutive weeks, prior to the date set for the election in the Bonners Ferry Herald, a newspaper published in Bonners Ferry, Idaho, and of general circulation in said school district.
